If you do not have a Will, you would die ‘intestate’ and your Estate (everything that you own) would pass in accordance with a framework of rules known as the ‘Intestacy Rules’. You may expect your spouse or civil partner to inherit everything under the Intestacy Rules, but this is not the case where there are children. Equally, you may expect that your partner (if you are not married or in a civil partnership) would be provided for but, under the Intestacy Rules, they would be entitled to nothing. With a Will in place, you can decide who inherits your Estate and in what proportions. You can also include provisions for substitute bene ciaries in the event your rst named bene ciaries die before you e.g., if you and your family died in an accident. If you have children from a previous relationship, a properly dra ed Will can ensure your current partner is provided for, whilst also protecting your Estate for your children. If you have children under the age of 18, a Will is important for the appointment of ‘Guardians’ to care for your children in the event of your death. Without a Will, this would be decided by the Court and could lead to arguments and upset in the family. Under a Will, you can decide who is to manage and administer your Estate on your death. ese people are known as ‘Executors’. Executors get the authority they need to administer your Estate from your Will. is means they can start administering your Estate straightaway. ey also have authority to arrange your funeral. Without a Will, somebody entitled to your Estate would have to apply for a Grant of Letters of Administration from the Court before they would have the required authority to administer your Estate. You may have specific wishes regarding your funeral arrangements and these wishes can be included in your Will so that your Executors know what type of funeral (if any) you would like and whether you wish to be buried or cremated. Our pets are our family! Under your Will you can make provisions for who will care for your pets on your death. is can avoid family arguments and pets being le with nowhere to go. If you own a business; are part of a partnership; or have shares in a limited company; you can make provisions under your Will for what is to happen to your business interests. Your Will can also give your Executors the authority they require to carry on your business a er your death. Having a valid Will in place will save time, money and stress for your loved ones.
