Advice from Jasper Vincent Solicitors e courts have a very wide discretion in the division of matrimonial nances and each case is decided by considering the facts of the particular matter. e overarching objectives are those of equality and fairness and the courts are guided by the factors set out in section 25 of the Matrimonial Causes Act 1973 (MCA) being the following: a) Welfare of a minor child/ren (under 18) of the family; b) Current income, earning capacity, property and other nancial resources as well as future income, earning capacity, property and other nancial resources; c) Current and future nancial needs, obligations and responsibilities of the parties to the marriage; d) Standard of living of the parties before the breakdown of the marriage; e) Ages of the parties to the marriage and the duration of the marriage; f) Any physical or mental disability of the parties; g) Current and future contributions either party has made/likely to make to the welfare of the family; h) Conduct of the parties, insofar as it would be inequitable to disregard it; i) Value of any bene t either party would lose due to the divorce; e factors in section 25 of the MCA are then assessed with reference to the principles of ‘meeting needs’, ‘compensation’ and ‘sharing’. Where an equal sharing of the matrimonial assets would adequately meet the needs of the parties and any child/ren of the family, this is usually the nancial outcome. Where there are insu cient matrimonial assets to adequately meet the needs of the parties and any child/ren of the family, the court may depart from the principle of an equal division or sharing. ‘Compensation’ seeks to redress any signi cant nancial disparity arising from the way the parties conducted their marriage. e division of matrimonial nances on divorce is very nuanced area of the law and it is therefore important that specialist legal advice is sought. Meachers’ former Commercial Director Gary Whittle has also taken over the role of Operations Director, following the retirement of Rob Lewis in March.
