The deceased Mr Ramus was separated from his wife and sadly took his own life. He made a Will leaving the residue of his estate into trust giving his wife a life interest where she was entitled to the income for her lifetime. She was unhappy with this for a number of reasons, particularly that the Trustees had the power to end her interest and she was unhappy with the choice of Trustees, particularly her daughter. In the letter of wishes that accompanied the Will he stated that he did not wish her to have the capital as he wanted it to be preserved for future generations. Mrs Ramus made a claim against her husband’s estate under the Inheritance (Provision for Family and Dependants) Act 1975, seeking reasonable nancial provision from the estate as she did not feel that the life interest was enough for her. e Court considered her needs and outgoings but concluded that Mrs Ramus had not made a case. is case has raised the awareness of claims under the 1975 Act and the use of trusts in Wills. Anyone who feels that reasonable nancial provision has not been made for them may have the option of making a claim against the estate under 1975 Act but they may not always be successful. Trusts can be very useful for various reasons, such as protecting assets when you have second marriages or concern about the cost of long term care fees utilising all of an estate. However, it is important to choose the executors and trustees of a Will carefully.
