It may be that you could make something known as an ‘Inheritance Act Claim’ or there could be other ways you could challenge a person’s Will, for example if you believe they have been coerced or didn’t have the capacity to make the Will. An Inheritance Act Claim best suits people who have been excluded or have not been le enough to meet their nancial needs. Claimants will generally be bereaved spouses, children or anyone who relied on nancial support from the deceased. ere are some exceptions to this general rule, but it is always best to explore them with your solicitor. It could also be that the deceased had an old or outdated Will which really ought to have been changed before they died or didn’t have a Will at all. ere is a crucial deadline to meet when you make an Inheritance Act Claim. If you miss the deadline, it becomes almost impossible to bring a claim, however strong your case might otherwise be. You have six months to make a claim, beginning on the date the Grant of Probate has been issued. Other claims have di erent time lines and you may need to act swi ly to place what is known as a caveat on the estate to prevent the Grant of Representation being issued and the executors administering the estate. Whichever type of claim you may need to make, you need to discuss it all rst with an expert in the eld who will discuss with you the strengths and weaknesses of making a claim.
