Sole Trader - Limited Company Self Assessment, Accounts, Payroll Please call Johanna on 023 8089 9365 Did you know... ere are two separate types of Lasting Powers of Attorney. e most common type deals with your Property and Financial A airs. is provides your attorneys with the authority to make nancial decisions on your behalf and grants them access to all of your nances. e second type of Lasting Power of Attorney covers your Health and Welfare and gives your attorneys the authority to make decisions on your behalf regarding your health and care needs when you are unable to. e Health and Welfare Lasting Power of Attorney also includes authority for the attorney to give or refuse consent for medical treatment and deciding where you live should you require care. Most people assume that those making the nancial decisions also make decisions relating to health and care, but this isn’t the case. Although there is no legal requirement that states you must have both in place, by choosing to have both types of Lasting Power of Attorney, you are ensuring that you are protected in the event of losing mental capacity in the future. Many people and families take out life cover by way of protection, however protecting yourself in the event of loss of capacity is o en overlooked. Nobody can foresee the future, however the level of protection an LPA provides ensures that if the worst did happen, you are in the safe and capable hands of your chosen attorney(s). By having LPA’s in place (and ensuring they have been registered) your attorneys are in a far better position to look a er you and act in your best interest if the need arises, rather than family members or friends nding themselves having to make an application to the Court of Protection to obtain a Deputyship Order, which is both lengthy and costly, at a stressful and emotional time for all involved. A common assumption with LPA’s is that they are only for the elderly or vulnerable members of our society, but this is not the case. Have you considered who you would nominate to look a er your a airs in the event of a life altering accident? Perhaps you travel o en overseas and it would be bene cial to delegate your powers to an attorney that is predominantly UK based. We recommend everyone should have LPA’s in place from the age of 18. By putting LPA’s in place today doesn’t mean you are giving up control - whilst you are still able to make your own decisions, your attorney does not have any control or access to your nances and decisions, unless you give them speci c consent to act on your behalf.
